TERMS AND CONDITIONS

IPV BHARAT PROJECT

A Social Welfare Initiative of IPV Surakshaa Kawach Charitable Trust

These Terms and Conditions govern membership, participation, welfare initiatives, facilities, assistance, and other benefits made available through the IPV Bharat Project and its public website/platform, operated by IPV Surakshaa Kawach Charitable Trust.

By applying for membership, making a membership contribution, accessing the website, participating in any programme, or applying for any facility, the applicant/member confirms that they have read, understood, and accepted these Terms and Conditions.

1. Nature of IPV Bharat Project

The IPV Bharat Project is a charitable and social welfare initiative of IPV Surakshaa Kawach Charitable Trust intended to develop and operate multiple welfare-oriented service sections for eligible beneficiaries.

The Project may provide or facilitate social, educational, religious, healthcare, legal, employment-support, financial-assistance, emergency-support, community-welfare and other lawful charitable activities.

The Trust may develop approximately thirty independent welfare sections, subject to its policies, infrastructure, operational capacity and availability of funds.

Membership does not create a contractual promise or guaranteed entitlement to any particular service, financial assistance, employment, income, pension, loan, scholarship, insurance, product, service, tour, or other benefit.

2. Public Welfare Website / Platform

The IPV Bharat Project may operate a public-facing website, digital platform, mobile application, communication channel or other online facility for providing information, registrations, applications, awareness campaigns, welfare programmes, promotional activities and access to charitable initiatives.

The website/platform is operated for the broader objectives of the Trust and its charitable and social welfare activities.

The availability of any facility displayed, announced, promoted or listed on the website shall not by itself constitute a guarantee that such facility will be available to every member or applicant.

The Trust may introduce, modify, temporarily suspend or discontinue any website facility or welfare programme whenever considered necessary.

3. Support Through Sponsors, Advertisers and Funding Partners

The Trust may undertake and support public welfare activities with the assistance of:

• Sponsors

• Advertisers

• Donors

• CSR contributors

• Supporters

• Philanthropic organisations

• Government or institutional grants, where available

• Voluntary contributors

• Lawful income generated through charitable activities

• Other lawful funding sources

Sponsors and advertisers may support particular programmes, campaigns, website operations, welfare activities, public awareness initiatives or other charitable objectives.

However, availability of sponsorship, advertising revenue, donations, CSR funds or any other funding shall not create a guaranteed obligation upon the Trust to provide any particular benefit to any particular member.

The Trust may allocate available funds according to its charitable objectives, priorities, policies and operational requirements.

4. Membership Eligibility

Membership shall generally be available to Indian citizens aged 18 years or above, subject to the eligibility requirements prescribed by the Trust.

The Trust may introduce separate categories or special welfare programmes for other categories of beneficiaries wherever legally and operationally permissible.

The Trust reserves the right to verify eligibility before accepting or continuing membership.

5. Membership Contribution – Strictly Non-Refundable

Membership may be obtained by making the applicable one-time membership contribution prescribed by the Trust.

The membership contribution shall be treated as a voluntary charitable contribution towards the objectives and activities of IPV Surakshaa Kawach Charitable Trust.

The membership contribution is strictly NON-REFUNDABLE.

Once the membership contribution has been successfully received and membership has been processed, the member shall have no automatic right to demand cancellation, reversal or refund of the membership contribution, irrespective of whether the member subsequently:

• does not use the website;

• does not participate in programmes;

• does not apply for benefits;

• does not qualify for a particular benefit;

• does not receive a particular benefit;

• becomes inactive;

• changes their mind; or

• is unable or unwilling to participate in the Project.

A refund shall be made only where mandatorily required under applicable law or where the Trust expressly determines otherwise in writing.

The membership contribution shall not be treated as a deposit, investment, loan, security, advance, purchase price, subscription guaranteeing benefits, or promise of financial return.

6. No Benefit Against Membership Amount

Payment of a membership contribution does not mean that the member has purchased or prepaid for any specific welfare service or benefit.

The amount contributed by a member shall not create a mathematical or proportional entitlement to receive benefits equivalent to the amount contributed.

For example, a higher membership contribution shall not automatically create a legal right to receive a higher-value benefit.

All welfare assistance shall remain subject to the Trust's policies and availability of charitable resources.

7. Sources of Funds

The activities of the IPV Bharat Project may be supported through available resources including:

1. Charitable contributions;

2. Donations;

3. Sponsorships;

4. Advertising support;

5. CSR contributions;

6. Grants, where applicable;

7. Support from individuals and organisations;

8. Lawful charitable activities; and

9. Other lawful sources permitted under applicable law.

The Trust does not guarantee that any particular source of funding will remain available for any particular period.

8. All Benefits Subject to Fund Availability

This is a fundamental condition of membership.

ALL BENEFITS, FACILITIES, ASSISTANCE, SUPPORT, SERVICES, PROGRAMMES AND WELFARE ACTIVITIES SHALL BE SUBJECT TO THE AVAILABILITY OF FUNDS AND RESOURCES WITH THE TRUST.

Availability may depend upon:

• Membership contributions;

• Donations;

• Sponsorships;

• Advertising support;

• CSR funding;

• Grants;

• Government support, if any;

• Other charitable contributions;

• Availability of products/services;

• Operational resources;

• Administrative capacity;

• Technical infrastructure;

• Applicable permissions; and

• Applicable law.

No member shall claim that registration or membership itself guarantees availability of any particular benefit.

9. Insufficient Funds

If sufficient funds or resources are not available, the Trust may, at its discretion:

• postpone a programme;

• delay assistance;

• reduce the scope of assistance;

• modify eligibility;

• prioritise certain beneficiaries;

• temporarily suspend a facility;

• discontinue a facility;

• change the implementation model; or

• discontinue a particular welfare scheme.

Such action shall not create an automatic right to refund the membership contribution.

The member acknowledges that the Trust cannot distribute funds that are not actually available to it for the relevant charitable purpose.

10. No Guaranteed Welfare Benefit

Membership does not guarantee:

• Financial assistance;

• Employment;

• Income;

• Pension;

• Loan;

• Scholarship;

• Medical assistance;

• Legal assistance;

• Emergency assistance;

• Housing assistance;

• Religious travel;

• Skill-development support;

• Business assistance;

• Product/service assistance;

• Insurance;

• Any monetary return; or

• Any other present or future benefit.

All such facilities, if introduced, shall remain subject to the applicable scheme, eligibility criteria, verification, availability of funds and approval of the Trust.

11. Sponsors and Advertisers Do Not Guarantee Member Benefits

The member understands that sponsors, advertisers and supporters may provide funding or promotional support to the Trust.

Such support may be:

• temporary;

• programme-specific;

• campaign-specific;

• conditional;

• limited in amount; or

• subject to the sponsor/advertiser's own policies.

The discontinuation, reduction or non-availability of sponsorship or advertising support shall not create a personal financial liability upon the Trust towards any member.

12. Welfare Programme Selection

Where a particular programme has limited resources, the Trust may establish eligibility and priority criteria.

Selection may consider:

• Eligibility;

• KYC verification;

• Financial/social need;

• Priority category;

• Availability of funds;

• Programme objectives;

• Availability of sponsors;

• Availability of goods/services;

• Verification results;

• Committee/authorised officer approval; and

• Other applicable programme conditions.

Registration or membership alone shall not constitute selection.

13. Thirty Welfare Sections

The Trust may gradually develop approximately thirty welfare sections, which may include:

• Health

• Education

• Legal Assistance

• Religious Welfare

• Emergency Support

• Senior Citizen Welfare

• Women Welfare

• Youth Development

• Employment Support

• Financial Assistance

• Disaster Relief

• Environment

• Social Security

• Skill Development

• Community Welfare

• and other charitable activities permitted under applicable law.

The Trust reserves the right to create, merge, modify, rename, postpone, suspend or discontinue any section.

14. Activation of Services

Welfare sections and facilities may be activated progressively according to:

• Fund availability;

• Sponsorship availability;

• Advertising support;

• Administrative readiness;

• Technical infrastructure;

• Availability of volunteers/personnel;

• Government permissions, where required;

• Availability of service providers; and

• Applicable legal requirements.

Any proposed timeline shall be treated as indicative unless specifically stated otherwise in a written programme document.

15. Use of Membership Contributions and Other Funds

Funds received by the Trust may be utilised for lawful charitable purposes, including:

• Public welfare;

• Welfare programmes;

• Medical camps;

• Education;

• Legal awareness;

• Religious and cultural activities;

• Technology and website operations;

• Public awareness campaigns;

• Administrative expenses;

• Staff and operational expenses;

• Infrastructure;

• Programme implementation; and

• Other lawful charitable objectives.

The allocation and utilisation of funds shall remain subject to the Trust's governing documents, applicable law and decisions of the competent authority of the Trust.

16. No Guarantee of Sponsor Availability

The Trust does not guarantee that sponsors, advertisers, donors, CSR contributors or funding partners will continue to support any particular programme.

A programme may therefore be changed, delayed, suspended or discontinued if the expected funding or resources are not received or become unavailable.

17. KYC and Verification

Members must provide accurate and genuine information and documents required by the Trust.

The Trust may reject, suspend or terminate membership where information is:

• False;

• Misleading;

• Incomplete;

• Fraudulent;

• Unverifiable; or

• Provided for an unlawful purpose.

18. Member Participation

Members may voluntarily support the Trust by:

• Promoting awareness;

• Sharing charitable initiatives;

• Participating in welfare programmes;

• Volunteering;

• Supporting public campaigns;

• Helping eligible beneficiaries; and

• Promoting lawful social welfare activities.

Participation does not create an employment relationship or guaranteed financial entitlement.

19. Referral / Promotional Programmes

If the Trust introduces any referral or promotional programme, such benefit shall remain subject to the applicable scheme rules.

Referral benefits shall not automatically constitute:

• Salary;

• Employment;

• Guaranteed income;

• Investment return; or

• Permanent commission.

The Trust may modify, suspend or discontinue such programmes according to its policies and applicable law.

20. No Investment or Profit Arrangement

Membership and participation in IPV Bharat Project shall not be considered:

• An investment scheme;

• Deposit scheme;

• Profit-sharing arrangement;

• Loan arrangement;

• Securities arrangement;

• Guaranteed income programme; or

• Commercial investment opportunity.

No return on the membership contribution is promised or guaranteed.

21. Website and Digital Services

The Trust may update, modify, suspend or discontinue any portion of its website, application, online registration system or digital service.

Temporary unavailability caused by technical issues, maintenance, banking issues, cyber incidents, third-party service interruptions or other circumstances shall not automatically create a refund or compensation obligation.

22. Suspension and Termination

The Trust may suspend or terminate membership where a member:

• Provides false information;

• Commits fraud;

• Misuses Trust facilities;

• Misrepresents the Project;

• Uses the Trust's name without permission;

• Engages in unlawful activities;

• Abuses Trust personnel or volunteers;

• Damages the reputation of the Trust; or

• Violates these Terms and Conditions.

Such suspension or termination shall not automatically make the membership contribution refundable.

23. Intellectual Property

All Trust logos, names, websites, project names, documents, software, videos, publications, promotional materials and other intellectual property shall remain protected by applicable law.

Unauthorised reproduction, commercial exploitation or misleading use of Trust intellectual property is prohibited.

24. Privacy and Member Information

The Trust may collect and use member information for:

• Membership administration;

• KYC;

• Verification;

• Communication;

• Welfare programme administration;

• Compliance;

• Website operations;

• Research and planning; and

• Other lawful charitable purposes.

Information may be shared where required by applicable law or with authorised service providers/supporting entities where reasonably necessary for programme implementation.

25. Force Majeure

The Trust shall not be responsible for delay, suspension or inability to provide any facility due to circumstances beyond its reasonable control, including:

• Natural disasters;

• Pandemic;

• Government restrictions;

• Court orders;

• Civil disturbance;

• War;

• Technical failures;

• Banking restrictions;

• Cyber incidents;

• Third-party service failures;

• Sponsor withdrawal;

• Funding shortage; or

• Any other circumstances beyond reasonable control.

26. Limitation of Liability

The member expressly acknowledges that the Trust's welfare activities are dependent upon available charitable funds, sponsors, advertisers, donors, operational resources and applicable legal requirements.

Accordingly, the Trust shall not be liable merely because a particular benefit is:

• unavailable;

• delayed;

• reduced;

• postponed;

• suspended;

• modified; or

• discontinued

due to insufficient funds, resources, sponsorship, advertising support, operational limitations or circumstances beyond the Trust's reasonable control.

Nothing in these Terms shall exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.

27. No Personal Liability of Trustees and Representatives

To the extent permitted by applicable law, members shall not personally proceed against the Settlor, Trustees, officers, employees, volunteers or representatives merely because a charitable programme could not be provided due to shortage of funds, sponsor withdrawal, operational limitations or circumstances beyond reasonable control.

28. Indemnity

To the extent permitted by applicable law, a member shall be responsible for losses, claims or proceedings arising from the member's fraud, unlawful conduct, misuse of Trust facilities, misrepresentation or material breach of these Terms.

29. Modification of Terms and Schemes

The Trust may modify these Terms and Conditions and may modify, introduce, merge, suspend or discontinue welfare programmes according to operational requirements and applicable law.

The latest applicable Terms published through the official website shall govern future participation, subject to applicable law.

30. Governing Law and Dispute Resolution

These Terms shall be governed by the laws applicable in India.

The Trust shall endeavour to resolve genuine grievances amicably.

Subject to applicable statutory rights and mandatory jurisdiction of competent authorities/forums, courts having jurisdiction over the registered office of the Trust shall have jurisdiction over disputes relating to these Terms.

31. Final Acceptance by Member

By registering for membership, paying the membership contribution, using the website, applying for any facility or participating in the IPV Bharat Project, the member confirms and agrees that:

1. The membership contribution is a charitable contribution and is non-refundable, except where refund is mandatorily required by law or specifically approved by the Trust.

2. Membership does not guarantee any particular benefit.

3. The IPV Bharat Project operates for public/social welfare purposes.

4. The Trust may depend upon sponsors, advertisers, donors, CSR contributors and other lawful funding sources.

5. All benefits are subject to availability of funds and resources.

6. The Trust may postpone, reduce, modify, suspend or discontinue benefits where adequate funds or resources are unavailable.

7. No membership contribution should be understood as an investment or guaranteed financial return.

8. The member accepts the decisions of the Trust made in accordance with its governing documents, programme policies and applicable law.

IMPORTANT FUNDING DISCLAIMER

IPV Bharat Project is a charitable social welfare initiative and not a guaranteed-benefit membership scheme. The Trust works for public welfare through its own available resources and with support from sponsors, advertisers, donors, CSR contributors and other lawful sources. Every welfare facility, assistance, or benefit is subject to the availability of funds, resources, sponsorship, and operational capacity. Payment of membership contribution does not create any guaranteed, vested or automatic right to receive any particular benefit, monetary assistance or service.
